1. Agreement to these terms
By using kingstumpgrindingco.com, submitting our quote form, or engaging King Stump Grinding for stump grinding, tree service, or land clearing work, you agree to these Terms of Service and to our Privacy Policy. If you do not agree, do not use the site or hire us.
2. What we do
King Stump Grinding provides residential and commercial stump grinding, related tree work, and small land clearing services across Hamilton County, Indiana, and the Indianapolis north metro. Specific services are described on our website. We will provide a written or texted quote before starting any paid work.
3. Quotes are estimates
Quotes are estimates based on the information you provide (size of stump, access, location). Actual cost may vary if site conditions are materially different from what you described. If we discover something on arrival that changes the scope, we will stop, explain the difference, and confirm the new price with you before continuing. You will never be charged more than the original quote without your explicit agreement.
4. Your responsibilities as the property owner or authorized contact
- You must have the authority to authorize stump grinding on the property (you are the owner, or you have the owner's permission)
- You will provide reasonable access to the work area on the scheduled date
- You will disclose any private utilities buried in the work area: irrigation lines, invisible fence wire, low-voltage landscape lighting, French drains, gas lines feeding outdoor fireplaces, etc. Indiana 811 does not mark these
- You will secure pets and inform us of any HOA architectural review requirements before work begins
- You will move any movable items (planters, hoses, lawn furniture) from the immediate work area
5. Indiana 811 and utility safety
We call Indiana 811 for a public utility locate before every job. This marks gas, electric, water, sewer, telecom, and other public utilities. We are not responsible for damage to unmarked private utilities (irrigation, invisible fence wire, low-voltage lighting, private gas runs, etc.) if you did not disclose them to us before work began. If you disclose them, we will work around them and assume reasonable care.
6. Scheduling, weather, and cancellation
We schedule jobs by appointment. We will text or call you 24 to 48 hours before your scheduled day to confirm and again when we are on the way.
Weather: we work in most conditions but reserve the right to reschedule for severe weather, frozen ground, or saturated lawns that would damage your property. We will notify you as early as practical.
Customer cancellation: we ask for 24 hours notice if you need to cancel or reschedule. Same-day cancellations (after we have dispatched) may incur a trip charge equal to our minimum service fee.
7. Payment
Payment is due upon completion of the work unless otherwise agreed in writing. We accept cash, check, debit card, and major credit cards. Commercial and HOA accounts may be invoiced with Net 15 or Net 30 terms by prior agreement. Returned checks incur a $35 fee. Past-due balances over 30 days accrue interest at the lesser of 1.5% per month or the maximum rate allowed by Indiana law.
8. Photography and marketing
We routinely photograph completed stump grinding work for our website, social media, and portfolio. Photographs may show the stump, the surrounding ground, the equipment, and our work in progress. We never identify your specific street address, never show your face without explicit written consent, and never tag or name you publicly without your permission.
If you do not want your project photographed for marketing purposes, tell us in writing (text or email) before work begins and we will respect that.
9. Insurance and liability
We carry general liability insurance covering our operations. A Certificate of Insurance is available on request for commercial, HOA, and pre-listing real estate jobs.
Limitation of liability: Our total liability for any claim arising from work performed is limited to the amount you paid for the specific service in question. We are not liable for indirect, consequential, or incidental damages (lost rental income, etc.). We are not liable for damage to private utilities you did not disclose, for pre-existing turf or landscape conditions, or for events outside our reasonable control.
10. Lawn settling and follow-up
Ground naturally settles in the weeks after a stump is ground out as the wood chips and backfill compact. This is normal and not a defect. If significant settling occurs within 30 days of completion, we will return at no charge to top off the backfill once. Beyond 30 days, additional top-offs are billed at our standard hourly minimum.
11. Stump regrowth
Grinding eliminates above-grade stump material and the buttressing surface roots. It does not kill every root tip in the soil. Some species (silver maple, hackberry, Bradford pear, certain ornamentals) may send up shoots from residual roots in the months after grinding. This is normal and not a workmanship defect. We can return to regrind regrowth at our standard rates.
12. Force majeure
We are not liable for delays or failure to perform caused by events outside our reasonable control: severe weather, equipment breakdown, supply chain interruption, government order, illness, or other circumstances of similar nature. We will give you as much notice as practical and reschedule promptly.
13. Governing law and disputes
These Terms are governed by the laws of the State of Indiana, without regard to conflict-of-law principles. Any dispute that we cannot resolve informally between us will be brought in the state or federal courts located in Hamilton County, Indiana.
Before filing any claim, you agree to give us 30 days written notice describing the issue and a reasonable opportunity to make it right. Most disputes are resolved with a conversation.
14. Indemnification
You agree to indemnify King Stump Grinding for any third-party claim arising from your breach of these Terms or your misrepresentation about the property or its conditions (for example, claiming authority to authorize work that you did not have). We agree to indemnify you for third-party claims arising from our negligent performance of the work, subject to the limitation of liability above.
15. Changes to these terms
We may update these Terms occasionally. The "Last updated" date at the top of the page reflects the current version. Material changes will be noted on the website for at least 30 days. Continued use of the website or our services after changes constitutes acceptance of the new Terms.
